Stalking

Definition of Stalking

Penal Code 646.9 defines a stalker as "any person who willfully, maliciously and repeatedly follows or harasses another person and who makes a credible threat with the intent to place that person in reasonable fear for his or her safety, or the safety of his or her immediate family."

Characteristics of a Stalker

  • Does not accept victim's decision that relationship is over
  • Manipulative
  • Unable to cope with rejection
  • Falls "instantly" in love
  • Difficulty distinguishing between fantasy and reality
  • Dependent on others for sense of "self"
  • Blames his / her situation on others

Common Behaviors of a Stalker

  • Persistent in following the victim
  • Multiple violations of a restraining order
  • Taking mail from the victim's mailbox
  • Showing up at the victim's home or work
  • Sending the victim letters, notes, e-mails and gifts that are threatening to the victim, either by themselves or when viewed with other conduct of the perpetrator
  • Vandalism
